What do you do when you defend yourself and you get arrested? Suppose the police believe the person who was attacking you?

There is nothing you can do in most cases \:\) They just want to know who started it first and not who was more injured.

Yeah, but in most cases it`s hard to prove, you are the victim, without a witness.

Ultimately it will become a his word against yours case, and I don't think that anything other than having a better lawyer than the other person will do any good for you.

It's a sad world, but at least you will be alive and well to go to court, rather than lying in a coma somewhere.

Then this is something that you just have to deal with. The ball wasn't all the way in your favor. So with that said you have to chalk it up as a lose. But if you were defending yourself at least you went out with a fight.

Thats pretty messed up that you got locked up for defending yourself. I think that I would have a law suit somewhere for that cop.

Well it depends. If you smash his head to little pieces than yes you should be arrested but if you just disable him enough time to get away there should be no problem.

There is a fine line between defending yourself and outright assault. If I was to kick a guy in the nuts and run, that would be self defense. If I kicked him in the nuts, kneed him in the nose, took my thumbs to his eyes and left his remains in 10 different trashcans in the area, then yeah, I'd get arrested.

Alright, a bit too far, but if you seriously injure them, you could get arrested.

Did you know that the other person does not technically have to hit or attack you first. If you feel threatened and that person is just following you around you can actualy hit them first. Still considered self defence.

It is obvious what you do, you make sure you notice details about the scene and what happened. You let the police investigate and get witnesses. And if you are being honest your story will be consistent and theirs will not be. You will usually be able to prove your innocence using the due process of law.

Ahh honesty doesn't always play out no matter what you say. I think that sometimes good people get overlooked. It happened to me. I was defending myself against an idiot who lied and I got arrested.

That situation is not a very good one to be in. Because it is their word against yours the police can't tell who is lieing and who is telling the truth. If there was a witness near by and you tell your story truthfully you should be ok but if there is not witness besides yourself you have little chance of getting the other person arrested. But if you were the one injured I would think that the other person would most likely get arrested because they attacked you. It really depends on the circumstances.

In some cases the cops don't care who is telling the truth. It's one thing to be walking down the street and someone come beat you up and you kick them in the nuts. But it's totally separate when it's a force home invasion, you draw a gun to defend yourself (inside your home, 'mind you), and the invader runs off and calls the police. Even though the court recognized the man was trespassing, the man was ordered to leave, somehow he wasn't there to hurt anyone? But, if you say "screw the moral options" and shoot the guy dead, you actually stand a better chance of getting off.

It seems like it's ok to be a criminal, but if you're a victim the court will make you pay again and again.

The truth will eventually surface. You just should play by you saying the truth and being honest. I am sure the one who is lying would be obvious enough to be caught..
